Privacy Policy

1. Amfab Designs having its registered office at 180, Sarjapur Main Road, Doddabommasandra, Bengaluru, Karnataka, India – 560125 (hereinafter referred to as “Amfab”, “We”, “Us” or “Our”) provides a web based portal entitled, “Amfab Designs” (“Portal”) available at https://amfab.in/. The Portal provides the Users (defined below) a facility to avail Amfab’s services (“Portal Services”).This Portal is a platform, for the end use of Users to avail the Portal Services.

1.1. This privacy policy shall be read with the Terms and Conditions. The capitalized terms existing in this privacy policy shall have meaning ascribed to them in the Terms and Conditions of the Portal available at URL https://amfab.in/.

1.2. This privacy policy explains how We collect, use, share, disclose and protect the information about the Users of the Portal provided therein (“Privacy Policy”).

1.3. We wish to express that Your privacy is of the utmost concern to Us. We shall treat any information received from You with the highest level of respect. We are committed to protecting and respecting Your privacy.

1.4. By using the Portal and Portal Services or by otherwise giving Us Your information, You will be deemed to have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the Terms and Conditions applicable to the Portal.

1.5. You hereby consent to our collection, use and sharing, disclosure of Your information, User Content as described in this Privacy Policy. We reserve the right to change, modify, add or delete portions of the terms of this Privacy Policy, at our sole discretion, at any time. If You do not agree with this Privacy Policy and the terms and conditions at any time, do not use any of the Portal Services available on this Portal or give us any of Your information. If You use the Portal Services on behalf of someone else or an entity, You represent that You are authorised by such individual or entity to (a) accept this Privacy Policy on such individual’s or entity’s behalf, and (b) consent on behalf of such individual or entity to our collection, use and disclosure of such individual’s or entity’s information as described in this Privacy Policy.

1.6. This Privacy Policy and the Terms and Conditions describes the types of personal information, User Content that We may collect about You, the purposes for which We use the information, the circumstances in which we may share the information and the steps that We take to safeguard the information to protect Your privacy. We may collect additional information required for better performance of Portal and providing Our Portal Services which shall be notified to You from time to time.

2. Information We May Collect From You


2.1. We may collect and process the following data about You:

a. Information You give us (“Submitted Information” includes User Content provided in the Terms & Conditions) Information You may give us information about You by registering on Our Portal, or by corresponding with Us (for example, by e-mail). This includes:

b. information You provide when You register on the Portal, subscribe to the Portal Service, and when You report a problem with the Portal, or the Portal Service. The information You give us may include Your name, date of birth, sex, NHS number, e-mail address and phone number, username, mailing address, postal code, username and password and other registration information, registration data required for creating an Account.

2.2. Information We collect about You and Your device. Each time You visit the Portal We may automatically collect the following information:

a. technical information, including the type of device You use, network information, Your mobile operating system, and time zone setting (“Device Information”);

b. information You have explicitly consented to sharing, and the providence of that data including the device used to collect that data, time, date (“Content Information”); and

c. details of Your use of the Portal or Your visits to the Portal and the resources that You access (“Log Information”).

d. If You contact us, We may keep a record of that correspondence.

2.3. If You choose to provide Us with personal information, You are consenting to the transfer and storage of that information on Our servers.

2.4. We collect and store the following personal information:

a. Information that You provide for filling in registration data, creating an Account on the Portal. This includes information provided at the time of registering to use Our Portal and/or Portal Services, subscribing to Our Portal Services, posting material or requesting further Portal Services. We may also ask You for information when You report a problem with our Portal.

b. Your full name, address, email address, telephone number, date of birth and bank or payment card details and any proof of Your identity and/or address that We may request;

c. We do not charge any fees at the moment. However we reserve a right to charge for fees in future for the Portal Services. We may collect such information required by Us in the event our Portal Services become subject to any fees in future. We reserve a right to collect such personal information including PAN, bank account details as required for collecting of fees from You in future. Information collected through “Cookies”;

d. Details of Your visits to Our Portal, including but not limited to, location data, web logs and other communication data, whether this is required for Our own purposes or otherwise and the resources that You access whilst visiting Our Portal.

e. demographic data (such as Your gender, Your date of birth and Your address, pin code);

f. data regarding Your usage of the Portal Services;

g. other information that You voluntarily choose to provide to us (such as information shared by You with us through emails or letters;

h. passwords;

i. details as provided at the time of registration or thereafter;

j. call data records;

k. details or information or Portal Services provided to Third Parties using our Portal Services and Citizen Portal; and

l. Details of transactions You carry out through our Portal.

2.5. If You/the User contact us, we may keep a record of that correspondence. When You want to register on our Portal as the User or would like to view/download properties on the Portal or comment on our Data, content, we may require You to provide us with certain personal information such as Your/User’s name, email address, designation, company, country and telephone number, for one or more of the following purposes: User ID creation, identifying User, contacting User and provide access to desirable content based on User’s preferences with regards to the software.

2.6. Certain information about You shall be automatically collected by the Portal such as User’s IP address, demographics, User’s device’s operating system, and browser type may be collected in order to provide better usability, troubleshooting and Portal maintenance.

3. IP Addresses and Cookies


3.1. We may collect information about Your browsing device, including where available Your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our Users’ browsing actions and patterns, and does not identify any individual.

3.2. For the same reason, we may obtain information about Your general internet usage by using a cookie file which is stored on Your device/system. Cookies containing information that is transferred to Your device. They help us to improve Our Portal and to deliver a better and more personalised service. They enable us:

a. To estimate our audience size and usage pattern.

b. To store information about Your preferences, and so allow us to customise our Portal according to Your individual interests.

c. To speed up Your searches.

d. To recognise You when You return to our Portal.

3.3. Cookies created on User’s device by using this Portal do not contain personally identifying information and do not compromise User’s privacy or security. We use the cookie feature only to store a randomly generated identifying tag on User’s.

3.4. We use traffic log cookies to identify which pages User finds useful and which User does not. This helps us analyse data about webpage traffic and improve our Portal in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. A cookie in no way gives us access to User’s device or any information about User, other than the data User chooses to share with us.

3.5. You may refuse to accept cookies by activating the setting on Your browser which allows You to refuse the setting of cookies. However, if You select this setting You may be unable to access certain parts of our Portal. Unless You have adjusted Your browser setting so that it will refuse cookies, our system will issue cookies when You log on to our Portal. Please note that our advertisers may also use cookies, over which we have no control.

4. Uses Made of the Information


4.1. The information submitted to us will be used primarily for the purpose of providing various Portal Services specified by us from time to time. Any information received is necessary to provide a level of certainty of intent and to maximize credibility. It may also be used to provide backup that may be helpful in Your desire to seek advice on various matters. It is also needed in order to aid with the continual improvement of the Portal, compile basic demographic data and to generally improve the Portal Services offered to You. Amfab will not sell, share or rent Your confidential information to any independent Third Parties without Your prior consent. As a customer, at Your request only, we will provide Your preferred method of contact information to any third party that You specifically request to contact with.

4.2. We may also use Your personal information to:

a. to facilitate Your use of the Portal;

b. to respond to Your inquiries or fulfil Your requests for information about the various Portal Services;

c. to provide You with information about Our Portal/Portal Services and to send You information, materials, and offers from us;

d. to help You address Your problems with the Portal including addressing any technical problems;

e. administer, operate, facilitate and manage Your relationship and/or account with Portal. This may include sharing such information internally as well as disclosing it to Third Parties, as described in the following paragraphs;

f. contact You or, if applicable, Your designated representative(s) by post, telephone, electronic mail, facsimile, etc., in connection with Your relationship and/or account;

g. provide You with information, recommendations, or advice concerning Portal Services offered by Citizen Portal;

h. facilitate our internal business operations, including assessing and managing risk and fulfilling our legal and regulatory requirements;

i. to conduct financial and identity checks; fraud prevention checks; anti money laundering and credit checks;

j. to resolve disputes;

k. transfer information as required by or under applicable laws, or similar legal process;

l. when we believe in good faith that disclosure is necessary to protect our rights, protect Your safety or the safety of others, investigate fraud, or respond to a government request;

m. with our trusted service providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

n. if the Company is involved in a merger, acquisition, or sale of all or a portion of its assets, You will be notified via email and/or a prominent notice on our Citizen Portal of any change in ownership or uses of this information, as well as any choices You may have regarding this information.

4.3. Further we would also use Your information for the purpose of:

a. providing You the Portal Services,

b. for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes,

c. for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to Third Parties and affiliates,

d. for communication purpose so as to provide You our Portal Services in a better way and obtaining feedback,

e. we reserve a right to use Your information and provide it to Third Parties in the manner suitable for providing our Portal Services.

4.4. We also reserve the right to use information provided by or about the You/User for the following purposes:

a. Publishing such information on the Portal;

b. Contacting Users for offering new products or services on the Portal;

c. Contacting Users for taking Portal Service feedback;

d. Analysing Portal usage patterns; and

e. Analysing anonymized information for commercial use.

4.5. We may also share personal information with our other corporate entities and affiliates to help detect and prevent identity theft, fraud and other potentially illegal acts; correlate related or multiple accounts to prevent abuse of our Portal Services; and to facilitate joint or co-branded Portal Services where such Portal Services are provided by more than one of our affiliate/ entity. Those entities and affiliates may not market to You as a result of such sharing unless You explicitly opt-in. We may disclose personal information if required to do so by Applicable Law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a Third Party; or protect the rights, property or personal safety of our Users or the general public. Should such a transaction occur or take place, that other business entity (or the new combined entity) will be required to follow this Privacy Policy with respect to Your personal information.

When You share and communicate using our Portal Services, You choose the people who can see what You share and You choose to message. In some cases, people You share and communicate with may download or re-share this content with others on and off Our Portal Services.

4.6. If Your relationship with Amfab under the Portal ends, we will continue to treat Your personal information; to the extent we retain it, as described in this Privacy Policy.

4.7. No administrator at Amfab will have knowledge of Your password and other sensitive information. You will be responsible to protect such sensitive information against unauthorized access to Your password, Your computer and Your mobile phone and other device used by You.

4.8. We make all User information accessible to its employees, agents or partners and Third Parties only on a need-to-know basis, and binds only its employees to strict confidentiality obligations.

4.9. We may retain and submit all records of Your information to the relevant Third Parties for providing Portal Services.

4.10. Notwithstanding the above, We will not at any time be responsible for the confidentiality, security or distribution of Your personal information by our partners, affiliates, employees, agents and Third Parties outside the scope of our agreement with such partners and Third Parties, affiliates, employees and agents.

4.11. Further, We shall not be responsible for any breach of security or for any actions of any Third Parties or events that are beyond our reasonable control including but not limited to, acts of government, computer hacking, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

4.12. We may use Third-Party advertising companies to serve ads when You visit our Citizen Portal. These companies may use information (not including Your name, address, email address, or telephone number) about Your visits to our Citizen Portal in order to provide advertisements about goods and Portal Services of interest to You.

5. Confidentiality of Information


5.1. Access to information provided by You shall be allowed to employees, officers, agents, affiliates who we believe reasonably need to come into contact with that information to provide Portal Services to You or in order to do their duties.

5.2. Users who use any of the features on the Portal and the Portal Services agree and accept that they have been fully informed that the use of features may lead to publication to all Users of the Portal of any information that may be posted by them while using any feature/ Portal Services on the Portal. Users further agree that the authenticity of, and consequences from the posting by Users of any information about themselves or any other person, are the sole responsibility of the User.

5.3. Users further agree and accept that the terms of the Privacy Policy will be applicable to the use of all features, existing and new available on the Portal. The Users agree and accept that confidentiality of information posted on such Portal/ Portal Services has been waived by the Users of such Portal/Portal Services themselves.

6. Protection of the information


6.1. We invest in high-quality security to protect User privacy. We follow strict security procedures in the storage and disclosure of information which You have given us, to prevent unauthorised access.

6.2. The following additional information will be of interest to You as a User to this Portal:

a. in order to provide efficient and reliable Portal Services and to improve the Service options available to You, all the entities registered with Amfab may be given, or given access to, Your personal information. This would be done to facilitate settlement of Your transactions or the maintenance of Your accounts, or as part of its arranging for the performance of specialized Portal Services. When so sharing Your personal information, we adhere to applicable industry standards regarding the protection of personal information.

b. We do not disclose Your personal information to Third Parties, except as described in this policy. Third party disclosures may include sharing such information with non-affiliated companies/ Third Parties that perform features/ part of Portal Services for Your Account or facilitate Your transactions with Portal, including those that provide professional, legal or accounting advice to Citizen Portal. Non-affiliated companies that assist Portal in providing Portal Services to You are required to maintain the confidentiality of such information to the extent they receive it and to use Your personal information only in the course of providing such Portal Services and only for the purposes that Portal dictates.

6.3. We may also disclose Your personal information to fulfil Your instructions, to protect our rights and interests and those of our business affiliates, partners. Finally, under limited circumstances, Your personal information may be disclosed to Third Parties as permitted by, or to comply with industry practices.

6.4. This Privacy Policy provides a general statement of the ways in which We protect Your personal information. You may, however, in connection with specific Portal Services offered by Portal, be provided with privacy policies or statements that supplement this Privacy Policy. This Privacy Policy may be changed from time to time to reflect changes in our practices concerning the collection and use of personal information. The revised Privacy Policy will be effective immediately upon posting to our Portal. We reserve a right to obtain additional information deemed fit for providing Portal Services. We may also change the manner in which we use your information best suitable to provide you with the Portal Services. By accepting this Policy you agree to be bound by the Terms and Conditions of the Portal and any amendments done from time to time.

6.5. Identity theft and the practice currently known as “phishing” are of great concern. Safeguarding information to help protect You from identity theft is a top priority. We do not and will not, at any time, request Your credit card information or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.

7. Data Security


7.1. We use a number of mechanisms (encryption, passwords, and physical security) to protect the security and integrity of User’s personal information against unauthorized access and disclosure. Unfortunately, no data transmission over the internet can be guaranteed to be completely secure. So while we strive to protect such information, we cannot ensure or warrant the security of any information/ User Content that the User transmits to Portal. Once we possess any personal information;

7.2. we will take reasonable steps to protect that information from misuse and loss and from unauthorized access, modification or disclosure.

8. Data Retention


We may retain Your information as long as there is a business requirement to do so, or if otherwise required under Applicable Laws.
